COMPREHENSIVE PRIVACY NOTICE FOR MOXIGE LUSHI CLIENTS (Mexican Attorney)

IDENTITY AND ADDRESS OF THE DATA CONTROLLER

LANDERO BONFIGLIO LAW FIRM, S.C., operating under the trade name “Moxige Lushi” (墨西哥 律师 – Mòxīgē Lùshí) (the “Data Controller”) through the website www.moxigelushi.com, with registered address at the World Trade Center Tower, Mexico City, located at 38 Montecito Street, 16th floor, Office 34, Colonia Nápoles, Benito Juárez District, Mexico City, ZIP Code 03810, and with contact email addresses asesoria@landeroasociados.com and/or informa@landeroasociados.com, is responsible for processing the personal data you provide to us, in accordance with the Federal Law on the Protection of Personal Data Held by Private Parties published in the Official Gazette of the Federation on March 20, 2025 (the “Law”) and other applicable regulations.

This Notice applies to our clients and to individuals who request information, a case evaluation, or a quote from us through any means, including our website www.moxigelushi.com, email, phone, and messaging apps.

“Moxige Lushi” (Mexican Lawyer – Mòxīgē Lùshí) is a trademark used by the Principal to provide legal services to domestic and foreign clients, particularly Chinese-speaking clients, and does not constitute a separate legal entity.

DATA COLLECTED

Personal data will be collected verbally, in writing, electronically, or by any other means, such as:

  • Name or legal name, including, if applicable, its spelling in Chinese characters.
  • Identification information, including the information contained in your passport or official identification document.
  • Nationality and immigration information (visas, residence cards, and immigration documents).
  • Legal representation information: notarial deeds, powers of attorney, foreign corporate documents, and information about their representatives and contact persons.
  • Federal Taxpayer Registry (RFC) number or foreign tax identification number and billing information, if applicable.
  • Address in Mexico or abroad, email address, phone number, and messaging app IDs (for example, WeChat, Telegram, or WhatsApp).
  • Line of business or activity and company size, when applicable.
  • Handwritten or electronic signature.
  • Information and documentation related to your legal matter, including translations, apostilles, or legalizations.

Depending on the nature of the matter you entrust to us, and only to the extent necessary to address it, we may also collect the following:

  • Civil status and family relationship information (e.g., birth or marriage certificates).
  • Asset or financial information (for example, bank statements, tax returns, information on assets, income, or investments).
  • Sensitive personal information, when the matter requires it (for example, health information in employment, family, civil, or social security matters).

For the processing of financial or asset-related data, we will request your express consent, and for sensitive personal data, your express written consent—in both cases, prior to receiving the information. The documents you provide to us may contain data from third parties, such as family members; you agree to obtain the necessary authorization to share such data with us.

When you provide us with personal data belonging to third parties (for example, your employees, job applicants, or suppliers) for the purpose of providing the service, you will remain the data controller for such data, and we will process it as a data processor, solely on your behalf and in accordance with the applicable service agreement.

PURPOSES OF PROCESSING COLLECTED DATA

  6. Professional communication, service assistance, and follow-up, including with the support of interpreters or translators.
  7. Billing and Collections.
  8. To comply with legal, tax, and professional obligations, as well as those related to the prevention of conflicts of interest.

These purposes include providing services to domestic and foreign customers.

  • For statistical purposes.

You may object to the processing of your data for secondary purposes by sending an email to the addresses listed in this Notice within five (5) business days after this Notice has been made available to you, or at any time thereafter. Your objection will not be grounds for denying you our services.

OPTIONS AND MEANS THE CONTROLLER OFFERS DATA SUBJECTS TO LIMIT THE USE OR DISCLOSURE OF THEIR DATA

The data subject may send an email addressed to the Personal Data Department of LANDERO BONFIGLIO BUFETE JURÍDICO, S.C. at asesoria@landeroasociados.com and/or informa@landeroasociados.com, requesting that the use or disclosure in question be restricted and to be removed from internal records used to contact them for promotional, advertising, and marketing purposes. They may also register with the Public Registry to Prevent Advertising (REPEP) of the Federal Consumer Protection Agency (PROFECO) through its website at http://repep.profeco.gob.mx/.

By restricting the use or disclosure of your personal data, you may no longer receive information related to our secondary purposes.

MEANS TO EXERCISE THE RIGHTS OF ACCESS, RECTIFICATION, CANCELLATION AND OPPOSITION (ARCO) TO THE PROCESSING OF PERSONAL DATA

To file an ARCO request, the data subject or their legal representative must submit the following required documents:

  • The name of the account holder and their address or other means of notifying them of the response to their request.
  • Documents proving the identity or, if applicable, the legal representation of the account holder.
  • A clear and precise description of the personal data with respect to which you wish to exercise any of the aforementioned rights.
  • Any other information or document that helps identify the personal data.

The application may be submitted in Spanish, English, or Chinese; the response will be provided within the timeframes established by law, through the same means by which the application was submitted.

TRANSFER OF PERSONAL DATA

Since Moxige Lushi serves both domestic and international customers, your data may be transferred to:

  • Correspondent attorneys, notaries, or public brokers and specialists who assist in handling your case, in Mexico or abroad.
  • Translators and interpreters, as well as technology, storage, and communications providers who provide services to us.
  • Competent authorities, when there is a legal obligation or a duly substantiated and justified request, or when it is necessary to carry out the necessary procedures or to defend their interests in the matter entrusted to them.

When such third parties process the data solely on behalf of and in accordance with the instructions of the Data Controller, such transfers do not require your consent. Transfers will be made in the circumstances and with the security measures provided for by law, including international transfers necessary for the provision of services, for example, to the customer’s country of origin or residence. No additional transfers will be made without your consent, except as permitted by law.

CHANGES TO THE PRIVACY NOTICE

This Privacy Notice may be amended due to legal or operational changes, or changes in our data processing practices. Any amendments will be available on our website, www.moxigelushi.com, along with the date of the most recent update, and may also be communicated via email or by any other means determined by the Data Controller.

MEANS TO REVOKE CONSENT

At any time, the data subject may request the revocation of the consent granted to LANDERO BONFIGLIO BUFETE JURÍDICO, S.C. to process their personal data by submitting a written request to the Personal Data Department at asesoria@landeroasociados.com and/or informa@landeroasociados.com or by delivering it to the Data Controller’s address, Monday through Friday from 9:00 a.m. to 3:00 p.m., clearly specifying the data for which consent is being revoked.

Conditions and Effects of Withdrawal: We may not be able to accommodate your request or terminate the use of your data immediately in all cases, as we may be required by law to continue processing your personal data. Furthermore, revoking your consent for certain purposes may mean that we can no longer provide you with the service you requested, or that your relationship with us will be terminated.

LANDERO BONFIGLIO BUFETE JURÍDICO, S.C. processes the aforementioned personal data in accordance with the Federal Law on the Protection of Personal Data Held by Private Parties, as currently in force, its implementing regulations, and other applicable laws and regulations.
